The transition to sustainable energy is in full swing. In this connection, the Dutch and EU authorities are pursuing an active policy; the Energy Agreement for Sustainable Growth concluded in 2013 by the Social and Economic Council of the Netherlands is one example of this. You are also likely to encounter the development of technology for storing electricity and sustainable power generation such as ‘blue’ energy, in the energy sector. And this entails an increasing amount of legislation and regulations. It is very important that you – as an entrepreneur – keep yourself well informed of new legislation.
Examples of changing laws and regulations include the Heating Supply Act, the Mining Act and all the appurtenant national and international legislation and regulations, as well as regulations governing offshore wind energy. The current Dutch Electricity Act and Dutch Gas Act are being revised and combined into one act. This revision constitutes a significant part of the ‘STROOM’ legislation agenda. The aim of this Bill is to support energy transition and provide a framework for sustainable power supplies in the future. In addition, depending on your own situation, you will be confronted with laws and regulations on financing and immovable property or mergers, acquisitions and joint ventures, or with competition and procurement law, administrative law, environmental law, and monitoring of legislation and regulations relating to energy law.
