Matthijs Gardien

Specialisation

Matthijs is a lawyer and advises and litigates in the field of commercial contracts and IT law. He specialises in preventing and resolving commercial disputes and has extensive experience in litigation and attachment law.

Besides knowledge of all kinds of commercial contracts, for instance in the field of assignments, distribution and agency, Matthijs also has extensive knowledge and experience in drafting, assessing and negotiating franchise contracts for franchisors, as well as (legally) assisting franchisors with the set-up and/or further development of their franchise formula(s).

He has particular affinity with tech (including artificial intelligence, data and software). He has extensive experience with complex issues within the platform economy, on automation disputes, in the field of licensing and concerning e-commerce.

Matthijs is well versed in attachment and enforcement law, including evidence seizures, litigation on 843a claims, European bank attachments and lifting summary proceedings.

Matthijs also frequently works for clients in the energy sector, litigating for them on disputes relating to supply agreements and wind farms, among other things.

Matthijs also enjoys working with start-ups and scale-ups. Partly because of his commercial background, he can empathise with entrepreneurs and often acts as a sparring partner for decision-makers.

Background

Matthijs graduated from Erasmus University Rotterdam in 2014. During his studies, he fulfilled a commercial position at an international trading company. After completing a student internship at Ploum in 2014, he started his career as a legal consultant in November 2014. Since November 2015, he has been working as a lawyer and as of 1 January 2024, Matthijs was appointed as partner.

Matthijs completed the Grotius Specialisation Course in National and International Contracting cum laude in early 2021.

In addition to his work as a lawyer, Matthijs regularly publishes, in particular on (the explanation of) commercial contracts, including continuing performance contracts, law governing attachments and executions and procedural law in the broadest sense of the word. Matthijs is the regular annotators of the legal journal “Case law in the Netherlands” (Jurisprudentie in Nederland – JIN). In addition, Matthijs is Secretary to the Rotterdams Juridisch Genootschap (RJG).
