Lisa Orvini

Specialisation

Lisa Orvini has specialised in construction law, real estate, contract law, property law, litigation and arbitration. Her expertise covers complex construction, real estate and infrastructure projects. In this she advises contractors, employers and project developers.

Lisa has gained extensive experience in advising on, drafting and negotiating complex construction contracts (including UAV-gc 2005, UAV 2012, FIDIC, Turn Key contracts, Design & Build and DBFM(O)). She does so in the context of the project as a whole, with equal attention to other project-related contracts such as purchase agreements, cooperation agreements and agreements with architects and other advisors (including DNR 2011). She always advises pragmatically and solution-oriented.

Lisa advises and litigates in construction law and other civil law disputes. This includes disputes between employers and contractors, but also more fundamental issues such as the question of whether or not an agreement has been concluded. She gives her clients a realistic understanding of their position and, where possible, tries to resolve disputes without going to court. In legal proceedings, Lisa works in a structured and thorough manner. Lisa has litigation experience in both civil courts and in arbitration at the ICC, the NAI (Netherlands Arbitration Institute) and the Dutch Arbitration Board for the Building industry.

For Lisa, the combination of both drafting and negotiating contracts and litigation is important. The contract work gives her a lot of insight into the sector, the client's daily practice and the business case of a project. She uses this knowledge in her advice on disputes and legal proceedings. At the same time, disputes and procedures give her the best understanding of the importance of clear contractual agreements and the risks in the absence thereof.

Examples of recent work

  • Advising an Amsterdam housing association on the purchase and Turn Key realisation of a large housing complex;
  • Advising an employer on the development and construction of a large tank terminal in the port of Rotterdam;
  • Lender’s co-counsel on the project financing of an infrastructure PPP project;
  • Litigating in an ICC arbitration for a Dutch company in storage and transhipment about the termination of a FIDIC Yellow Book 1999 contract;
  • Litigating in in multiple summary proceedings at the Rotterdam Court, as well as a successful appeal procedure at the Court of Appeal in The Hague regarding a FIDIC Yellow Book 1999 contract for the design and build of a terminal in the port of Rotterdam.

Lisa Orvini has registered the following principal (and secondary) legal practice areas in the Netherlands Bar’s register of legal practice areas (rechtsgebiedenregister):

  • Real estate law (vastgoedrecht), sub legal practice area construction law (bouwrecht).

Based on this registration, Lisa Orvini is required to obtain ten training credits per calendar year in each registered principal legal practice area in accordance with the standards set by the Netherlands Bar.
