Waste law

Waste law is a very complicated area of law. This is largely due to the fact that there are many national and international laws and regulations that apply to anyone handling waste materials. A second complicating factor is the definition of "waste": a substance is a waste material as soon as the holder discards or is required to discard it. The question of when this is the case has been considered by many, and there is a substantial amount of case law with regard to this question.

Simultaneously, our society is striving to become increasingly circular. This means that we aim to produce less and less waste, and we are increasingly reusing substances. Nonetheless, our clients still regularly have differences of opinion with the authorities about the question when something is waste, and when it is not. Legal advice from a lawyer is, in such cases, often a 'must'.

This is how we can help you

We often advise on such questions; we provide assistance to tank storage companies, (other) companies in the industrial sector, refineries and companies producing biofuels, construction companies, etc.

Not only do our lawyers have substantive expertise in the field of waste law, they also have years of experience with the administrative and criminal law enforcement that often results from the above-mentioned differences of opinion (see also our website regarding "Enforcement and Sanctions" and "Economic Criminal Law").

  • We assist our clients when they have questions about their products and/or waste materials and/or about the permits they need and/or how these wastes should be disposed of;
  • We issue legal opinions;
  • We also assist clients when they have to answer to administrative or criminal law for alleged violations of - for instance - the Environmental Management Act.
